OSRAM SYLVANIA Inc. (“OSRAM”) transfers by sale the samples or items identified above/below (“Items”) to the Buyer identified above/below.
The Items are sold as is, where is and with all faults. OSRAM EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES FOR THE ITEMS.
The Items and related technical information are subject to the export controls, trade restrictions, embargoes and sanctions of the U.S. and other countries (“Export Laws”). Buyer must comply with all applicable Export Laws and ensure that the Items and technical information are not sold or marketed directly or indirectly to any prohibited person, organization or nation, for any prohibited purpose, or otherwise in violation of Export Laws.
Buyer unconditionally releases OSRAM and its affiliates, officers, directors, employees, agents and contractors from any claim arising out of the acceptance, use or eventual disposal of the Items.
